"eumom.ie" means Eumom Marketing Limited of 101 Monkstown Rd., Dun Laoghaire, Co. Dublin, Ireland with registered no. 318793.

2. User obligations
You will use this site appropriately and in accordance with these terms and conditions and all other applicable laws, licences and regulations. In particular you will not directly or indirectly place on the website anything or do anything as the case may be while using the site in relation to its Content that includes but is not limited to the following:
- Infringes on the intellectual property rights or related rights of any third party or any rights of publicity or privacy
- Violates any law, statute or regulation

- Contains pirated software or constitutes an act of software piracy

- Enables any hacking.
2.1. The User is, and at all times shall be, an end user of the Service, and the User shall not resell or sub-licence in exchange for payment the service or information provided on the Eumom website to any third party without the written permission of Eumom. The User is responsible for the actions of any person who avails of this service or accesses the information through the User's registration with Eumom.
2.2. The User will comply with all reasonable instructions given by Eumom from time to time in connection with the use of the service.
3. User indemnity
The user shall indemnify Eumom, its promoters, contractors, servants, employees, advisors or agents, against any and all losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of profits, loss of business, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), liabilities, claims, damages, settlements, awards, costs, expenses and proceedings incurred by Eumom, its promoters, servant, employees and/or agents in consequence of the user's use or misuse of this site or the information or the resources contained on or accessible through this site or infringement of intellectual property rights, and/or by reason of any breach of these terms and conditions of use and/or due to the act, error, omission, default or negligence of the User or of any third party who has access to this site via the User's connection or otherwise howsoever arising.
4. Eumom's obligations
This service and information is provided without any warranties or guarantees. All implied conditions, terms and warranties that may arise under Statute, custom, usage, in equity, tort, at common law or otherwise, are hereby expressly excluded to the fullest extent permitted by law. User confirms that this is fair and reasonable. Eumom does not warrant that the supply of this service and information shall be without interruption or deterioration or that reconnection can be achieved within any specific time or period or that any network through which internet connection is achieved will at any time in the future be accessible and compatible with this service, or will continue to operate as it does currently.
4.1. Eumom has no editorial relationship with any link sites. Accordingly, we make no warranties, representations or guarantees about them, or any products, content or services which may be provided through any link sites. Furthermore, the inclusion of these links is not intended to reflect the importance of, or vouch or warrant, these other sites or endorse any of the views expressed in, or products or services offered by, such sites. For the avoidance of doubt, Eumom is not the provider, seller, reseller, disseminator or agent of any of the goods or services offered for sale on any of the sites with links to or from the site and neither does Eumom warrant or make any representations, warranties or otherwise in any manner whatsoever about any of such goods or services.
5. Exclusion of liability
Eumom shall not be liable to the User or any third party for any losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of data, loss of profits, loss of business, business interruption, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), whether based on breach of contract, tort (including negligence), product liability, statute, equity or common law, or howsoever otherwise arising out of or in any way connected with the use, performance or contents of this site or any other site. We do not guarantee the accuracy or completeness of any information on this or any other internet sites and shall not be liable in any way to you for their use or performance or reliance on same. However, nothing in this Agreement shall exclude or restrict liability of either party for death or personal injury resulting from gross negligence.
For the avoidance of doubt and without prejudice to any other provisions contained in these terms and conditions, Eumom disclaims all express or implied representation or warranties regarding the information, services, products, materials and any other resources available on or accessible through this site, including (without limitation) any implied warranties of merchantability, fitness for a particular purpose or non infringement. All such information, services, products, materials and other resources are made available "as is" and "as available" without any representation or warranty of any kind.
Eumom disclaims all responsibility and liability of any description, including without limitation, liability for negligence, incidental or consequential damages and/or loss suffered by any person acting or refraining from action as a result of or in connection with this site, to include any reliance placed by such person on such material, or the viewing or use or performance of this site.
Eumom assumes no responsibility for computer systems, hardware, software or programme malfunctions or for other errors, failures or delays in computer transmissions or network connections that are human or technical in nature, or for lost, late, or otherwise damaged or misdirected information. Eumom, reserves the right, in its sole discretion, to cancel or suspend this programme at any time without notice should a virus, bug or other causes beyond Eumom's control corrupt the administration, security or proper function of this programme.
Eumom shall have no responsibility or liability to the User for any errors or interruptions in (or any delay in reinstatement of) the Service, whether arising out of a failure of any telecommunications lines, operated by any telecommunications operator, or hardware/software service interface, other connection points of any other network providers equipment or services or of any other network.
6. Commencement, term and termination
Eumom may disconnect this service at any time without notice to the user if:
- The user is in breach of any terms of this Agreement
- The user is suspected of an involvement with fraud or acts which are of a defamatory, offensive, abusive, obscene, menacing, unsuitable or unlawful character in connection with the use of the Service; or
- Eumom is required by the order of any court or regulatory authority to discontinue the provision of this service, or is deemed necessary by Eumom to disconnect the service in order to prevent the commission of any offence or the continuance of any unlawful activity.
In addition and as Eumom's absolute right, Eumom may terminate this Agreement and/or discontinue this service immediately at any time and without notice at Eumom's sole discretion.
7. Intellectual property
You confirm and acknowledge that all copyright, trade marks (registered or unregistered) and other intellectual property rights of whatsoever nature arising from all materials, content and information on this site, including the site's design, layout and organisation, are owned or licensed by Eumom. Except as stated herein none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form by any means, including but not limited to, electronic, mechanical, photocopying, recording or otherwise without the prior written permission of Eumom. Permission is granted to access, download, or print such material for your personal, non-commercial use only and is subject to these terms and conditions.
8. Amendment
Eumom reserves the right to amend these terms and conditions at any time. Any such amendments will be valid immediately once they are posted on the Eumom website. This Agreement cannot be otherwise altered without prior consultation with Eumom.
9. No waiver
Failure to act with respect to any breach of any rule whatsoever by you or any other user shall in no way effect our future right to act with respect to future similar breaches.
10. Severability
In the event that any provisions of this Agreement are held to be unenforceable, illegal or void in whole or in part, the remaining portions of the Agreement shall remain in full force and effect.
11. Governing law
This Agreement and the resolution of any dispute related to this Agreement or this site shall be governed by and construed in accordance with the Law of Ireland, and the parties hereby submit to the exclusive jurisdiction of the Irish courts for all matters arising in connection with or in any way related to this Agreement.
12. Notices
Written notice under this Agreement is satisfied by the sending of an electronic message with confirmed delivery to (in the User's case) the email address registered with Eumom or (or in the case of Eumom) to
info@eumom.ie.
13. Data protection
Eumom.com will comply with its obligations under the Data Protection Act, 1988 & 2003 and any other applicable legislation. Any information about the User obtained by Eumom and registration for the Service or through the user of the Service will be retained and used by Eumom for its own internal purposes (to include monitoring use of the Service, traffic management purposes, service upgrades etc). Eumom may also use any information obtained from the User for purposes of marketing Eumom's and other party's products and services.
